Introduction

Rules and regulations are made to govern many situations throughout life. Some are as preventative measures and some are for instructional purposes. At the Royal Windsor Terrace, Rules and Regulations are formulated so that you, as residents, will be aware of the facilities you can enjoy using in the building.

The most important rule is the Golden Rules-"Do unto others as you would have done unto you."

It is your obligation to read and follow these Rules and Regulations.

Any infractions of these Rules and Regulations will be dealt with by your Board of Directors or Property Manager, the cost of which will be charged back to you.

1.  AMENITY AREAS/COMMON AREAS

These areas include the pool area, exercise room, shower, squash, racquetball courts, pool room, party room and lobby.

  • Residents are required to accompany guest to the amenity areas to ensure that Regulations are observed. Guest on extended visits need not be accompanied by a resident if they (the guests) register with the manager.

  • Residents alone are entitled to entertain guests--guests are not permitted to bring their own guests into the amenity areas.

  • Large groups other than family groups are not permitted.

  • Loitering and entertaining is not permitted in the Lobby.

  • Persons using any amenity area shall leave the area in the same condition in which it was found.

  • Hours for use of all amenity areas shall be posted or as changed from time to time by Board resolutions.

  • In accordance with City By-Laws smoking is not permitted in the saunas, pool area, change rooms, exercise room, elevators, corridors, lobby, billiard room, stairways, etc., all of which are considered common areas.

  • The last person leaving the sauna and hot tub, irrespective of the time of day, shall turn them off.  Please turn off the lights in this area as well as the lounge lights.

THE POOL

  1. Clothes should not be taken into the swimming pool areas. They should be left in the dressing room where hooks are provided.

  2. Showering with soap is required before entering the pool or whirlpool by order of the Board of Health.

  3. No food, beverages or glass objects are not allowed in the pool area.

  4. Bathers entering the building or the elevators are required to wear footwear.

  5. Scuba or other similar equipment are not allowed in the pool.

  6. Children under six years old are not allowed in the hot tub and children six to twelve years of age are allowed with adult supervision only.

  7. No radios, stereos, tape decks or musical instruments may be used in the amenity areas, except exercise video tapes may be used in the fitness room.

2.  GARAGE

  1. Each residential unit has been allocated one (1) parking space for RESIDENTIAL USE ONLY. There is no second car parking space presently available except through your yearly parking lottery. The draw for the Parking Lottery Spaces usually occurs at the Annual General Meeting. These spaces are available for Residents in possession of more than one vehicle.
    Parking spaces are not to be used for storage purposes. This includes window washer fluid, etc. Bicycle racks can be obtained and installed for a charge. Please contact the on-site management staff.

  2. Car speed in and out of the parking garage is 5 m.p.h. or 9 km p.h. Please observe and obey this rule since there been many near collisions.

  3. It is necessary to use a remote door opener to enter the garage.

    1. The exit door is not to be used to enter the garage except in an emergency; nor is the entrance door to be used as an exit.

    2. If you approach the garage door while it is in motion allow it to close before activating it again.

    3. Failure to do so will result in needless repair expenses to the garage door as well as your vehicle.

    4. Cost of repairs will be charged back to the person responsible.

  4. No boat, trailer, camper, snow, mobile, machinery or equipment (except equipment used for services here) shall be stored on the property.

  5. No repairs or adjustments (except of an emergency nature) shall be made to the motorized vehicles anywhere on the property (i.e. common areas, parking garage, etc.). Motor Vehicle engines should not be left idling.

  6. Oil and grease residues in any parking space must be cleaned by the occupant of such space. (The building manager has some absorbent compound which is available upon req, , uest).

  7. The vehicle leaking oil will have to be repaired within 30 days of notification or the owner of said vehicle will be charged for the clean-up in the amount of $75.00.

  8. Vehicles which are parked without authorization in a space not assigned to the owner of such ve, hicle will be towed away at the expense of the violator. If you have a visitor parking in your parking space a Parking permit is required by you, authorizing them to do so, with the office laminate Permit.

  9. Vehicles which are parked in such a manner as to block other vehicles or to interfere with the movements of traffic will be towed away at the owner's expense of the violator.
    Varying air pressure in the building causes some doors not to close securely at times. The parking area doors to the elevators are particularly susceptible to the condition. Please ensure that the doors close securely behind you.

3.  MOVING, UNIT PREPARATION & RENOVATION

  1. Work on units (noisy renovations etc.) must not begin before 8 a.m., Monday to Saturday. No work can be done after 7:30 p.m. No work is allowed on Sundays.

  2. No large furniture deliveries or workers with tools and equipment are to enter through the front lobby--they must use the back door and the service elevator.  Occupants are responsible for making arrangements with the on-site management in advance (24 hours).

  3. Trades people are required to leave common areas clean. When employed for an individual unit, the owner is responsible for clean-up. Building Material resulting from renovations or remodeling must not be put down the garbage chute. Owners must make their own arrangements for disposal off site.

4.  LAUNDRY ROOM

  1. To be used by occupants only.

  2. Those using the washers and dryers must leave the machine clean; this includes the removal of lint from the dryers.

ELECTRIC DRYERS

Did you know that 50% of your common fees go for utilities? Therefore, please be aware that the dryers installed in the laundry rooms can be set to run for up to 130 minutes (2 hours and 10 minutes). An average load can be completely dried in approximately 45 minutes. Any time beyond that not only wastes hydro but also weakens the,, , fabric.

RUGS ARE NOT TO BE DRIED IN THE MACHINES.

WASHING MACHINE

The laundry rooms are not equipped with commercial rated washers; they cannot handle overloads.  Overloading causes equipment breakdown and other problems.
RUGS ARE NOT TO BE WASHED IN THE MACHINES.

5.  GARBAGE

  1. All garbage must be put down the chute in small, tightly tied plastic double bags; this helps in pest control.

  2. All recyclable items must be brought to the ground floor refuse room and deposed of in the appropriate bins.

  3. Large boxes and other items must be taken to the ground floor refuse room. The boxes must be broken down and piled neatly in the room.

  4. The garbage chute shall not be used between midnight and 7:00 a.m. in order to reduce noise during the night.

6.  KEEPING OF PETS

  1. Pets are not allowed in the building- as per declaration Item IV (k) and item- III (5a.b.c.).

7.  INDIVIDUAL UNITS

  1. Condominium fees are due on the first day of each month and can be dropped off through the mail slot in the office door that is located on the second floor. The general practice is to send 12 post-dated cheques. Once an owner becomes more than 60 days in arrears of their common fees, the file is sent to the Corporation's lawyer and a lien is issued against the unit. Legal Fees, late fees, interest charges, $30.00 N.S.F. fees and administration charges will also be added to the account.
    A $25.00 late fee will be added for payments received after the 1st of the month and must be dropped off in the second floor office. All payments will be posted to the oldest arrears.

  2. SALES OF CONDOMINIUM UNITS: Open house concept of selling is not permitted. Units to be shown by appointment only.

  3. INSURANCE: According to the Corporation's Declaration and By-laws as well as the Condominium Act, R.S.O. 1998, all Condominium Corporations must carry Directors and Officers, Boiler and Machinery and General Liability Insurance.
    However, the interior surfaces of the perimeter walls, ceiling and floor of your unit are not covered by the Condominium policy. Owners are responsible for insurance for their units for liability of betterments, improvements and contents.

  4. FIRE HAZARDS: No resident shall bring into the building or permit anything to be done which will increase the risk of fire, such as natural Christmas trees. Electrical circuits must not be overloaded.

  5. IN ACCORDANCE WITH THE DECLARATION: Except with the prior consent in writing of the Board of Directors, no owner or tenant shall make any structural change or alteration in or to his unit including the removal and installation of toilet, bath tub, wash basin, sink, heating, air conditioning, plumbing or electrical installation contained in or forming part of his unit, or alter the design, or make any change to or installation upon common elements, or maintain, decorate, alter or repair any part of the common elements except for maintenance of those parts of the common elements which he has the duty to maintain.

8.  BALCONIES AND PATIOS

  1. Nothing shall be placed on the outside of the balcony rails and/or be thrown from balconies.

  2. No awnings or shades may be erected outside of the walls of the building without written approval of the Board of Directors.

  3. No brooms, mops, dusters, rugs or bedding may be shaken from any door, window or balcony.

  4. Balconies are not to be used for storage.

  5. No outside hanging or drying of clothes is allowed.

  6. When balcony floors are washed, water must not flow over the floors below.

9.  NOISE

  1. Residents, families and guest shall not cause noise which disturbs other residents. Sounds from stereo, televisions, radio and musical instruments shall be controlled.

  2. Parties and entertainment which cause loud noise after 11 p.m., to the extent that neighbouring residents are disturbed, are not permitted. If necessary, upon failure to subside, complaint should be reported to the Police Department.  (Tickets from the police department are $135.00 for any disturbance and noise violation).

10. GUESTS

  1. No one will be allowed to enter your unit in your absence unless you have advised the manager accordingly or in the case of a true emergency.

NOTE: UNITS NOT OCCUPIED FOR EXTENDED PERIODS

Equipment having hose connections such as dishwashers, icemakers, etc., must have the water shut off when away for extended periods. This will relieve pressure in the hose forestalling possible bursting of the hose with disastrous results.

11. FIRE HAZARDS

  1. Occupants should make certain that baseboard heaters in the units and in the storage areas are kept clear of flammable materials.

  2. In accordance with Workplace Hazardous Materials Information System and all fire code, municipal and provincial regulations; No hazardous or combustible materials are to be kept on the property. Such materials including gasoline, and similar inflammable fluids and gases. Propane tanks for barbeques being kept on outside balconies must be in compliance of the appropriate government authority, transporting of such tanks must also be in compliance of the appropriate municipal and provincial authority.

  3. Attention is called to Paragraph 11/(1)(h) of the Declaration which reads as follows:
    No unit shell be occupied or used by anyone in such a manner as to result in increase in the rate of the fire insurance on the property or threat of the cancellation, of any policy of insurance maintained pursuant to Act or this Declaration.
    Accordingly, NO FIRES of ANY KIND are allowed on the property.

FIRE ALARMS

Smoke detectors located in each unit are not connected to the building fire alarms system.  They alert the occupants of the unit only and such occupants must ensure such detectors are in proper working order.  If you telephone the fire department for assistance, please alert the building custodian to facilitate building access for the firemen. The "Pull Signal Alarm" boxes, located on each floor and throughout the building, sounds the building alarms and alerts both fire department and building custodian.

12. PARTY ROOM

  1. This room is for the use and pleasure of all residents. It cannot be reserved on Freedom Festival Fireworks Night and other occasions that may be determined by the Board. The Fire Marshall has restricted the entire patio room, including the roof area, to 180 people.

  2. No resident may arrange for a non-resident to have the use of the Party Room for any reason (i.e. parties, meetings, etc.).

  3. Any private party or event shall not have more than 80 persons, including minors (those under 18 of age), nor shall it extend beyond 1:00 a.m.

  4. There shall be no music after midnight, and the volume of music must be controlled so that other residents are not disturbed.

  5. Private use of the Party Room must be arranged in advanced with the manager. The Party Room will be leased to adults only. Contract forms, providing details, are available at the office. All Party Room rentals require a written contact, Board approval and a deposit at the time of reservation.

  6. No food or beverages of any kind are permitted on the roof top patio at all times.

  7. The use of the Party Room will be restricted to personal non-business functions and any acceptable uses that the Board deems proper.  The board reserves the right to refuse an individual permission to reserve the Party Room, where in the opinion of the Board such refusal would be in best interest of the Condominium Corporation.

  8. No notice or sign shall be placed in or around the front lobby or vestibule announcing the party or advising the method of entrance. Smoking is not permitted in the Party Room, halls, stairwells or rooftop.

  9. It is the responsibility of the person reserving the Party Room to ensure the admittance of their guests. The building managers should not be disturbed for this purpose.

  10. The person reserving the Party Room is responsible for all their guests and they must be in the present at all times during the period reserved.  It is their responsibility to ensure that these rules relating to its use are observed by their guests.

  11. Nothing shall be attached to the walls of the Party Room. The elevator must be reserved for caterers with the manager prior to this event.

  12. Overshoes, rubbers, boots, carpets or other impediments must not be placed on the common area hallways or outside of the unit doorways. (PER FIRE CODE)

  13. Hallway heater thermostats are to be set only by the building manager.

13. STORAGE AREAS

  1. "Storage of perishable items (i.e. fruit, vegetables, etc.) is prohibited in unit storage rooms due to offensive odours and the danger of attracting vermin, insects etc."

  2. In accordance with the Fire Code there must be an 18" clearance of any sprinkler head in the storage areas.

14. GENERAL

  1. Canvassing and distribution of leaflets in the building is not permitted except as provided in the Condominium Act.

  2. Flagrant violation or disregard of rules will result in the corporation proceeding with all means at their disposal up to and including legal action, the cost of which will be charged back to the offender.

BUILDING SECURITY

To ensure that people without keys do not follow you through any entrance door. Any visitors to the building should be buzzed in by the person they wish to visit.

15. REQUIREMENTS FOR LEASING

(TOP) 

Where a unit Owner shall lease such unit, the Tenant shall deliver to the Owner and the Corporation wherever requested by either of them, an acknowledgement and covenant signed by the Tenant, to the following effect:


"I, ____________________________, covenant and agree that I, the members of my household, and my guests from time to time, will, in using the unit rented by me and the common elements, comply with the Condominium Act, the Declaration, the By-laws, and the rules of the Condominium Corporation, during my tenancy."

At the time of entering into any lease of any unit, the owner shall notify the Corporation in writing of the existence of the Lease, the same and address of the tenant, and the address of the owner.


Any new commercial or tenancy Lease Agreements and/or Lease Renewals must be reviewed by a Committee appointed by the Board of Directors before being finalized.
